Terms of Service

PaintQuoteKing helps painting contractors turn walkthrough information into a draft estimate. It structures what you record into rooms, surfaces, preparation and estimated quantities, then calculates labour, materials and pricing using the rates you configure.

Every estimate is a draft for you to review. The service assists with estimating; it does not survey, measure or inspect a property, and it does not decide your prices.

This is the most important term. Quantities the software could not derive from what you supplied are marked as inferred or assumed and listed under “Things to confirm”. You are responsible for checking every figure before sending a quote to a customer.

We do not warrant that any estimate is accurate, complete or sufficient for a particular job. Site conditions, hidden damage, access, substrate and product behaviour cannot be determined from notes and photographs. You remain solely responsible for the quotes you issue, the prices you charge and the contracts you enter into with your customers. We are not a party to those contracts.

You must provide accurate details and keep your password secure. You are responsible for activity under your account. Tell us promptly at support@REPLACE_ME if you believe it has been accessed without your permission.

One account is for one business. Do not share logins across separate businesses.

The Free plan includes 3 AI analyses in total. Paid plans include 30 (Solo) or 100 (Pro) AI analyses per billing period. Everything else — building estimates by hand, editing, pricing, quotes and PDF export — is unlimited on every plan.

Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. You can cancel at any time from the billing portal; you keep your paid plan until the end of the period you have already paid for, then return to Free.

We do not provide refunds for partial periods unless required by law. Your right to a remedy under the Australian Consumer Law, or equivalent legislation where you live, is not affected by these terms.

We may change prices with at least 30 days’ notice by email. Continuing to use a paid plan after that notice means accepting the new price.

You keep all rights in the content you put into the service — your notes, photographs, recordings, customers, estimates and rates. You grant us only the licence needed to operate the service for you: to store that content, process it to produce your estimates, and send the parts you choose to our AI provider for analysis.

We do not use your content to train AI models, and we do not sell it. See the Privacy Policy for who processes what.

You can export any quote as a PDF at any time. If you close your account you may request a copy of your data before it is deleted.

You agree not to:

• upload content you do not have the right to upload, including photographs of a property taken without permission;
• attempt to access another organisation’s data, or probe or circumvent our security;
• resell or white-label the service without our written agreement;
• use automated means to exceed plan limits, or share one account across separate businesses;
• use the service for anything unlawful.

We aim to keep the service available but do not guarantee uninterrupted access. We may suspend it for maintenance, and we rely on third parties (hosting, database and AI providers) whose outages can affect us. AI analysis in particular may be temporarily unavailable — when it is, you can still build and price estimates by hand.

Nothing in these terms excludes any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

Subject to that, and to the maximum extent permitted by law: the service is provided “as is”; we are not liable for indirect or consequential loss, lost profits, lost business or loss arising from an inaccurate estimate or an underquoted job; and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose.

You may stop using the service and delete your account at any time. We may suspend or terminate an account that breaches these terms, with notice where practical. We may also discontinue the service entirely, in which case we will give reasonable notice and a period during which you can export your data.

We may update these terms. If a change materially affects your rights we will tell you by email or in the app before it takes effect. Continuing to use the service after that means accepting the updated terms.

These terms are governed by the laws of New South Wales, Australia, and the courts there have non-exclusive jurisdiction.
